Terms and Conditions of Use

1. Acceptance of Terms

By submitting a job post, application, or otherwise using Forsa Connect ("Platform"), you agree to these Terms and Conditions. If you do not agree, do not use the Platform. You also agree to our Privacy Policy.

2. Nature of Service

Forsa Connect is an online platform that connects freelancers and jobseekers ("Talent") with companies or individuals seeking services ("Employers").

  • We do not employ Talent.
  • We do not control or guarantee the work provided by Talent or the payments made by Employers.
  • All contracts, negotiations, and payments are solely between Talent and Employers.

3. Independent Contractors

Talent are independent contractors, not employees or representatives of Forsa Connect. Talent are responsible for their own taxes, compliance with laws, and the manner in which they perform their services.

4. Payments

The Platform does not process, hold, or facilitate payments for work performed between Talent and Employers. All compensation, invoicing, and payment terms must be negotiated and fulfilled directly between the parties. The Platform may charge fees to Employers for posting jobs or for other optional platform services. All such fees are collected exclusively through third-party payment processors (such as Stripe). The Platform does not store, control, or have access to users’ full payment information and assumes no liability for any payment processing errors, chargebacks, fraud, or disputes arising from third-party services. The Platform bears no responsibility for non-payment, delayed payment, or any financial disputes between Talent and Employers.

5. User Responsibilities

Users agree to:

  • Provide accurate, lawful information in any submission (job posts, applications, resumes).
  • Not use the Platform for unlawful, fraudulent, or harmful purposes.
  • Not post harmful, misleading, or inappropriate content, including:
    • Illegal job offers or services.
    • Fraudulent or deceptive posts.
    • Spam, bulk postings, or irrelevant offers.
    • Contact details such as WhatsApp numbers or links intended to bypass the Platform.
    • Content that is discriminatory, harassing, or harmful.

We reserve the right to remove any submission at our discretion without notice.

6. Use of Candidate Data

By submitting your information, you agree that:

  • We may use your email address to send newsletters, service updates, or promotional materials. You may unsubscribe at any time.
  • We may share candidate information (including resumes and email addresses) with Employers, recruiters, advertisers, or trusted third-party partners, subject to applicable law and user consent.

7. AI-Powered Processing

By submitting resumes or application materials, you acknowledge that your data may be shared with third-party AI services for analysis. We do not control their outputs and are not liable for inaccuracies, bias, or security issues resulting from such processing.

8. Moderation and Removal

We may remove any job post, application, or submission for any reason, including spam, harmful content, or violations of these Terms. Removal does not create any obligation to review or monitor all submissions.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Employers will find Talent or that Talent will find work.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Forsa Connect will not be liable for indirect, incidental, special, or consequential damages.
  • Our total liability will not exceed the greater of: (a) $100 USD, or (b) amounts paid to Forsa Connect by you in the six (6) months before the claim.

11. Governing Law & Disputes

These Terms are governed by the laws of the United States of America/Virginia. Any disputes will be resolved exclusively in the courts of Virginia. Users waive any right to participate in class or collective actions.

12. Changes

We may update these Terms at any time. Updates will be posted on the Platform, and continued use constitutes acceptance.
